1. AGREEMENT TO TERMS

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Airmass Sustainables (Private) Limited ("Company," "we," "us," or "our"), governing your access to and use of the Airmass Xpress mobile application ("App") and related services ("Services").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App.

2. DESCRIPTION OF SERVICES

The App allows Clients to post tasks, receive competitive bids from Service Providers, and hire professionals. Airmass Xpress acts solely as an intermediary platform and is not a party to any agreement between Clients and Service Providers.

4.1 Registration

You must create an account to access the full features of the App. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or behave in a manner harmful to other users or the platform.

5. POSTING TASKS AND BIDDING

5.1 Task Posting

Clients may post tasks describing the work they need completed. Task descriptions must be accurate, lawful, and not misleading. Tasks must relate to legitimate services within the construction and built environment sectors.

5.2 Bidding

Service Providers may submit bids on posted tasks. Bids constitute an offer to perform the described work at the stated price. Clients are free to accept, reject, or negotiate any bid.

5.3 Acceptance

Once a Client accepts a bid, both parties enter into a direct contractual relationship. Airmass Xpress is not a party to this contract and bears no liability for the performance, quality, or outcome of the work.

6. PAYMENTS

6.1 Payment Processing

Payments are processed through integrated mobile wallet services. By using the payment features, you agree to the terms of our third-party payment service providers.

6.2 Fees

Airmass Xpress may charge service fees or commissions on transactions conducted through the platform. Any applicable fees will be clearly disclosed before you confirm a transaction.

Payment disputes between Clients and Service Providers should be resolved directly between the parties. Airmass Xpress may, at its discretion, assist in mediating disputes but is under no obligation to do so.

While we may offer identity verification and badge features for Service Providers, verification does not constitute an endorsement, guarantee, or warranty of any user's skills, qualifications, or reliability. Users are responsible for conducting their own due diligence before engaging with others on the platform.

9. INTELLECTUAL PROPERTY

All content, trademarks, logos, and intellectual property associated with the App are owned by Airmass Sustainables (Private) Limited. You may not copy, modify, distribute, or create derivative works from any part of the App without our prior written consent.

By posting content on the App (such as task descriptions, reviews, or profile information), you grant us a non-exclusive, royalty-free licence to use, display, and distribute such content for the purpose of operating and promoting the platform.

10. LIMITATION OF LIABILITY

You agree to indemnify, defend, and hold harmless Airmass Sustainables (Private) Limited, its directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the revised Terms within the App or on our website. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

The App may integrate with or link to third-party services (e.g., Google Maps, payment providers). Your use of such services is subject to their respective terms and privacy policies. We are not responsible for the content, accuracy, or practices of third-party services.

15. FORCE MAJEURE

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, wars, government actions, power failures, or internet disruptions.

16. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Zimbabwe. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.

17. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
